• You represent and warrant that you have all necessary rights, licenses, consents, and authority to upload images of any individuals (including children) and to permit us to use such images for the purposes of our Service.
• We are not responsible for verifying your rights to upload images and assume no liability regarding the ownership or rights to any images you upload.
• You agree to indemnify and hold us harmless from any claims arising from your uploaded content.

• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service or content generated through our Service without express written permission.
• We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

• The Service and its original content, features, functionality, and all content generated through our Service (including AI-generated stories, characters, and images) are and will remain the exclusive property of Digital Tandem Limited.
• You receive a limited, personal, non-exclusive, non-transferable license to use the generated content for personal, non-commercial purposes only.

2.2 User Content

• By uploading images or providing information, you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and create derivative works based on such content for the purposes of providing our Service.
• You waive any moral rights you may have in content you upload.

3. Payment Terms

3.1 Pricing

• We charge $9.90 USD per personalized story, unless otherwise specified.
• We reserve the right to change prices at any time without prior notice.

3.2 Payment Methods

• Payments are processed through third-party payment processors under their respective terms and conditions.
• You agree to provide accurate payment information.

3.3 Billing

• You will be charged immediately upon confirming your order.
• All charges are final and non-refundable.

4. No Refunds

• All sales are final. No refunds, credits, or exchanges will be issued for any reason.
• We reserve the right, at our sole discretion, to determine whether to provide replacements or adjustments to orders.
• We make no guarantees regarding the quality, accuracy, or suitability of the generated content.

5. Disclaimers and Limitations of Liability

• The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We expressly disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• To the maximum extent permitted by law, Digital Tandem Limited shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims is limited to the amount you paid for the specific product that is the subject of a claim.
• We are not liable for any content generated by our AI systems, including any potentially inappropriate, inaccurate, offensive, or disturbing content.

5.3 Service Availability

• We do not guarantee that the Service will be available, uninterrupted, secure, or error-free.
• We reserve the right to suspend or terminate the Service or your account at any time without notice.

6. Dispute Resolution

6.1 Governing Law

• These Terms shall be governed by the laws of Hong Kong, without regard to its conflict of law principles.

6.2 Mandatory Arbitration

• Any dispute arising from these Terms shall be resolved exclusively by binding arbitration in Hong Kong.
